Passenger Transportation and Service Agreement
This Passenger Transportation and Service Agreement (the “Agreement”) outlines the terms and conditions for transportation services provided by ALO TRNASPORTER to its passengers.
1. Parties
This Agreement is made between ASIL HOLYDAES (hereinafter referred to as “ALO TRANSPORTER”), operating passengers (hereinafter referred to as the “Passenger”) who make reservations through www.alotransporter.com and/or on behalf of whom reservations are made.
Unless otherwise specified, “ALO TRANSPORTER” and “Passenger” shall collectively be referred to as the “Parties” and individually as a “Party”.
2. Subject of the Agreement
With this Agreement, the Parties agree on the following:
For airport transfers within the borders of ISTANBUL , before and after the flight, the transfer service purchased by the passengers in the airport-address or address-airport directions is provided with the specified vehicles. This service is collected by “ALO TRANSPORTER ” for the determined price, within the framework of the terms of this Agreement.
3. Service and Payment Information
- 3.1. Pricing: The contract price is stated in the service details and includes all applicable taxes.
- 3.2. Payment Authorization: By proceeding, you accept that all fees for the transfer service you have received and/or will receive under this Agreement will be charged by “ALO TRANSPORTER” to your credit card, which you will enter on the STRIPE screen. You authorize “ALO TRANSPORTER” to process this credit card withdrawal.
- 3.3. Invoicing Period: Invoices for purchased services will be issued within 7 days, including the date of purchase, provided the current month is not skipped, in accordance with V.U.K. (Tax Procedure Law).
4. General Provisions
- 4.1. Passenger Conduct & Safety: Passengers must comply with all relevant legislation, especially the Highway Traffic Law. It is mandatory to adhere to all safety rules, such as wearing a seat belt and following vehicle safety instructions.
- 4.2. Agreement Acceptance: When the passenger uses a credit or debit card for the transfer service, even without a physical signature, they are deemed to have accepted the written terms of this Agreement.
- 4.3. Reservation and Cancellation:
- To use the transfer service, reservations must be made at least 4 hours before the transfer time.
- For religious and national holidays, New Year’s Eve, and other public holidays, reservations must be made at least 48 hours before the transfer time.
- Reservations can be canceled by the Passenger up to 48 hours before the transfer time for a full refund of the service fee.
- No refunds will be made for cancellations made outside of these specified times.
- 4.4. Route Changes: Passengers are not authorized to change the pre-determined route for any travel services. Requests to stop at different locations or wait along the route are not accepted. For VIP transfer services, additional charges will apply for any different point requests not specified in the contract.
- 4.5. Vehicle Allocation and Responsibility:
- “ALO TRANSPORTER” will allocate a vehicle suitable for the number of passengers and baggage volume determined at the time of booking.
- All vehicles allocated for service under this Agreement will be fully insured for personal accident and seat, undergo periodic maintenance, and carry mandatory equipment such as a spare wheel, first aid kit, fire extinguisher, and reflector.
- “ALO TRANSPORTER” is not responsible for any bodily or material damage to the customer, or damage to transported goods, resulting from traffic accidents or other reasons during the transfer. In such cases, the customer irrevocably agrees that “ALO TRANSPORTER” will not have any responsibility under Article 66 of the Code of Obligations or other legislative provisions.
- 4.6. Passenger and Baggage Limits: Except for passenger and baggage information submitted and accepted at the time of purchase, passengers or baggage exceeding the limits accepted by “ALO TRANSPORTER” cannot be brought into the vehicle. If the passenger cancels the transfer service for this reason, no refund will be issued.
- 4.7. Identity Verification: Passengers must certify their identity with legal ID documents and the reservation document to the vehicle personnel. Passengers who do not fulfill this obligation will not be transferred. However, “ALO TRANSPORTER” may allow service use if it is satisfied that the credit card holder for the reservation has consented to the Passenger receiving the service.
- 4.8. Lost or Damaged Belongings: “ALO TRANSPORTER” is not responsible for the loss or damage of any belongings left in the vehicle by the customer during the transfer. Passengers should immediately contact the Istanbul Shuttle Port call center on the day they realize an item has been forgotten. If found, the passenger must collect the item from the given address. Upon request and for a fee, “ALO TRANSPORTER” can deliver the forgotten item to the passenger’s specified address.
- 4.9. Baggage Restrictions:
- Bags, chests, parcels, etc., are not accepted as luggage in “ALO TRANSPORTER” transfer vehicles.
- Passengers have a maximum baggage allowance of 1 handbag (up to 8 kg) and 1 suitcase (not exceeding 32 kg) per person.
- Passengers accept, undertake, and declare that their baggage does not contain any flammable, combustible, explosive, narcotic, fluid, odorous, radioactive substances, or any items prohibited by United States legislation.
- If such items are noticed by the driver, the baggage will not be accepted into the vehicle. In these cases, the passenger cannot claim any receivables or claims against “ALO TRANSPORTER.”
- If prohibited substances are found, “ALO TRANSPORTER” will immediately report the situation to the competent authorities.
- If prohibited substances are not noticed by the driver but are detected by law enforcement during a stop and search, any damages and losses incurred by “ALO TRANSPORTER” and/or any third party will be immediately and fully covered by the passenger in cash.
- 4.10. Pet Transfers: Pet transfers in our vehicles are allowed only when placed in a secure cage, after providing prior information during booking, and without disturbing other passengers. Only cats, dogs, and small songbirds are transported as pets. The cage dimensions should be a maximum of 23 cm (height) x 40 cm (width) x 55 cm (length).
- 4.11. Passenger Information:
- 4.11.1. Contact Information: Reservation details or preliminary service information will be shared via email and/or SMS / Whatsapp . The accuracy of the telephone and email information provided by the passenger is their responsibility. “ALO TRANSPORTER” cannot be held responsible if the contact information is incorrect and the information does not reach the Passenger.
- 4.11.2. Pick-up Times: For shared transfers, the estimated pick-up time will be shared via email and/or SMS or Whatsapp 12 hours before the transfer. For VIP service, the service will be provided according to the pick-up and drop-off time determined by the passenger.
- 4.12. Airport Transfers (from a point to the airport):
- “ALO TRANSPORTER” commits that the allocated vehicle will be at the designated pick-up point at the transfer time.
- The Passenger is notified via email and Whatsapp before the transfer date and time.
- A delay of up to 20 (twenty) minutes is considered a reasonable delay, excluding extraordinary situations, unexpected events, force majeure, natural disasters (flood, hail, rain), or traffic jams.
- In locations like sites or mass housing complexes, “ALO TRANSPORTER” is not responsible for delays exceeding 20 minutes caused by security guards blocking vehicle access. If such a delay occurs and the Passenger does not wait for the vehicle, no refund will be issued.
- Passengers must be present with their luggage at the designated point at the transfer time.
- If the passenger is not present at the transfer point at the transfer time, the vehicle will wait for 10 (ten) minutes. If the Passenger does not arrive within this 10-minute period, the vehicle is not obligated to wait longer.
- Time notices from “ALO TRANSPORTER” operations, call center, and drivers are binding on both parties.
- 4.13. Airport Pick-ups (flight number not provided/delays): If the flight number is not provided, or in cases of delays or waiting for more than 1 (one) hour for any reason, “ALO TRANSPORTER” is no longer obligated to wait for a vehicle at the airport. For shared transfers, transfers will be made based on convenient time and vehicle availability. For VIP service, an appropriate vehicle will be allocated by “Istanbul Shuttle Port” and the service performed.
- 4.14. Service Guarantee and Compensation:
- “ALO TRANSPORTER” is responsible for ensuring vehicles arrive at service locations at the promised time.
- If a vehicle cannot perform an approved job due to an issue originating from “ALO TRANSPORTER” a second vehicle will be provided at no additional charge to the Passenger.
- If the second vehicle cannot reach the Passenger’s address on time, or the Passenger does not arrive on time with the second vehicle, “ALO TRANSPORTER” will cover all alternative transportation expenses required for the Passenger to reach the airport.
- In cases where the passenger must use another means of transportation (e.g., commercial taxi, public transport, personal vehicle), the service will either be provided again free of charge at a time the passenger wishes, or the amount paid for the service will be refunded to the credit card without deduction (upon presentation of a document).
- “ALO TRANSPORTER” will only cover the transfer loss incurred for the airport transfer if the customer misses their flight due to a defective service. This loss cannot exceed 200 (two hundred) USD under any circumstances.
- 4.15. Driver Assistance: At the transfer point, the vehicle driver is not obligated to leave the vehicle and accompany the passenger to the vehicle or their home.
- 4.16. Unaccompanied Minors: Children under the age of 16 will not be transferred without an accompanying adult or parental consent.
- 4.17. Wheelchair Transfers (Shared): If a wheelchair transfer is requested with a passenger for shared transfers, this must be stated by the passenger at the time of booking. Failure to do so will make the Passenger responsible for any resulting delays or inability to board the vehicle. Passengers with physical disabilities who can meet their personal needs can travel alone. However, passengers who cannot meet their personal needs must be transferred with a companion. Necessary reservations must be made for this companion, and the fee must be paid.
- 4.18. Online Payment Fees: An additional transaction fee may be charged to your ticket fee by your bank for online ticket purchases with a credit card. For detailed information, the passenger should contact their bank.
- 4.19. Pick-up Timings: Due to operational reasons at airports, your vehicle will pick you up within a minimum of 10 minutes and a maximum of 20 minutes from the designated time. For departures from an address, a 15-minute delay allowance is provided.
- 4.20. Seat Belt Use: Seat belt use is mandatory inside the vehicles. Our company reserves the right for our drivers to warn and terminate the journey of passengers who do not comply with this requirement. Passengers who do not fasten their seat belts accept in advance that they will be responsible for any financial and moral damages they may incur during the journey and for any damage they cause to the interior of the vehicle.
- 4.21. In-Vehicle Video Recordings: Video recordings are made inside the vehicles. These recordings are stored only on the vehicle and the main server. They cannot be shared with any third parties or passengers upon request. The retention period for the recordings is 9 full days. Passengers accept in advance that recordings are made inside the vehicle.
5. Cancellation – Refund Conditions
- 5.1. No Refund Conditions: If the times specified in this Agreement are exceeded and/or the conditions are not met, the right to cancellation cannot be exercised, and “ALO TRANSPORTER” will not refund the fee.
- 5.2. Online Cancellations & Refunds: If you made your reservation through “ALO TRANSPORTER” website, mobile application, or call center, you can make changes and cancellations up to 12 hours in advance through any of the online sales channels or the call center using your REF (Reference) Code and identity information. You will receive a full refund without interruption.
- 5.3. Passenger Responsibility: “ALO TRANSPORTER” will not be responsible if the Passenger does not comply with the obligations in this Agreement, if the reservation is canceled due to any fault or negligence of the Passenger, or if the Passenger does not receive the service. All legal rights of “ALO TRANSPORTER”, other than the collection of service fees, are reserved.
- 5.4. Suspicious Transactions: “ALO TRANSPORTER” has the right to hold transaction amounts until the Member’s approval for the Payment Transaction in cases of Suspicious Transactions and upon notification by the User or System Partner, especially in the following situations. Payments will not be definitively processed if the suspicious situation is finalized and documented:
- If there is any doubt that the Payment Transaction is not in compliance with legal provisions.
- If there is a suspicion that the Payment Transaction was made without the knowledge of the credit card holder used in the Payment Transaction.
- If there is a suspicion that the Payment Transaction was made without the knowledge of the bank account holder used in the Payment Transaction.
- If there is any doubt that the Payment Transaction is not an actual Payment Transaction (excluding tests).
- 5.5. Rules for Traveling with “ALO TRANSPORTER”:
- Do not consume alcohol or drugs while traveling in the vehicle.
- Avoid actions that may distract the driver.
- Do not speak loudly in the vehicle.
- Respect the rights of other passengers and avoid causing discomfort to anyone.
- Refrain from eating during the journey inside the vehicle.
- Avoid actions that may jeopardize the safety of the journey.
- Know and adhere to the obligation of wearing a seatbelt during the journey.
- 5.6. Governing Law and Jurisdiction: This Agreement will be governed by the Laws of Türkiye. The Courts and Enforcement Offices of Türkiye are authorized to resolve any disputes arising from the interpretation and application of this Agreement between the Parties.
